Marshal Ben Higbee was accidentally shot and killed when his pistol fell from its holster as he struggled with a suspect. The gun discharged with it struck the ground, and the round struck him in the groin.

He succumbed to the wound two days later.

Marshal Higbee had served with the agency for only one month.
