Policeman Herman Kirby was beaten to death with his own blackjack after responding to a disturbance call at a local restaurant.

When he arrived, he encountered the suspect, a youth on furlough from a nearby Civilian Conservation Corps camp. The officer attempted to take him into custody. The youth attacked him, gained control of his blackjack, and severely beat him. Policeman Kirby succumbed to his injuries several hours later.

The suspect turned himself in 3 days later and was sentenced to 10 years in prison.

Policeman Kirby had previously served as a guard at the Tennessee State Prison. He was survived by his wife and son.
