As he arrived on the scene, the man attempted to run him over and then fled at a high rate of speed. As the pursuit passed through the intersection with FM 1485, Sergeant Baumgartner's patrol car was broadsided by an SUV.<br \/>\n<br \/>\nThe impact pushed Sergeant Baumgartner's patrol car into a light pole and caused the SUV to overturn. Sergeant Baumgartner was transported to Memorial Hermann Hospital, where he succumbed to his injuries. An 11-year-old child in the SUV was also killed, and several other occupants were injured in the crash. The driver of the vehicle that was fleeing returned to the scene of the crash, where he was arrested and charged with murder and intoxicated manslaughter.<br \/>\n<br \/>\nThe subject was found guilty of evading arrest\/detention causing death, and sentenced to 15 years in prison.  <br \/>\n<br \/>\nSergeant Baumgartner had served with the Patton Village Police Department for over three years. They think it's funny to us. Theres no idea the pressure on an officer but we can't just let them go. We have no idea till apprehended why they are running. Some just killed an officer or someone else but hasn't hit dispatch yet. Some have kidnapped persons, drugs etc. in vehicle and yes some are just stupid. But although we have great superhuman powers we don't see thru things or read minds yet. We are condemmed if we do or if we don't. \nThe driving public should remember most states law requires that the civilian driver sees his or her way clear of intersection before entering no matter light or no light color of that light or any other traffic commands. Emergency vehicles when operating as such lights siren etc. although have to use caution have right of way.
