Patrolman John Hurley was shot and killed on Gallatin Street (modern-day French Market Place) near Hospital Street by a noted criminal who had recently been pardoned from prison by Governor Francis T. Nichols.

The subject was engaged in a fight with another man when Patrolman Hurley stepped in to separate them. The man placed a pistol to the breast of the officer and fired, the ball entering his heart. The man was apprehended, convicted of murder, and sentenced to life. He was pardoned again in December of 1908.
