Marshal DuVal was shot and killed by a prisoner he was escorting from Indian Territory (present day Oklahoma) to the federal court at Fort Smith, Arkansas. While camping out overnight northwest of Muskogee, Indian Territory, one of the prisoners took his handcuffs off, obtained Marshal DuVal's weapon, and shot him in the head. He then shot and wounded two other marshals before being shot and wounded. The suspect was convicted of the murder and hanged in 1874.
