Police Officer Daley was shot and killed by a couple of burglars on Michigan Avenu near Wayne Street. Another person, railroad Detective H. N. Pickell, was also shot and critically wounded by the burglars, as he came to the aid of Officer Daley.

Two brothers were arrested and charged with Officer Daley's murder. One was convicted of murder and sent to prison for life on March 1, 1905. The Michigan Supreme Court awarded him a new trial. He was released on September 6, 1906, when witnesses from the first trial could not be located. The other brother was acquitted.

Officer Daley had served with the Detroit Police Department for seven years. Detective Pickell recovered from his injuries.
