Constable Tubbs was shot and killed by a former mental patient when he went to his home with orders to have him recommitted. The suspect shot him in the head as he exited his patrol car. The suspect was apprehended later that night and was charged with murder.

The suspect, 61, was determined to be insane and committed to Rusk State Hospital. He died in Terrell State Psychiatric Hospital on March 13, 1996.

Minutes after the shooting, the search for the suspect turned tragic. A man, 63, retarded, with a child's mind, who always wore a toy pistol, and was known by almost everyone, was shot and killed by a Texas Ranger searching for the suspect. It was dark and he pointed his toy gun at the ranger. The ranger could not see his face well enough to determine who he was. After ignoring three orders to drop it, he was shot.

Constable Tubbs had been in law enforcement for four years.
