Sheriff Stockard was shot and killed as he and the Waverly marshal attempted to arrest a drunk suspect who was at another man's house, threatening to kill him. When the two lawmen arrived the suspect refused to surrender. The man suddenly produced a revolver and shot Sheriff Stockard at least six times.
The marshal returned fire but did not strike the suspect, who fled to his own home. A posse located the man there a short time later. The posse opened fire on the suspect when he refused to surrender.
