Officer Kime was shot and killed while he and another officer attempted to arrest three men at the Missouri Pacific depot. The men were wanted for attacking a citizen with stones and revolvers. As they attempted to arrest the men Officer Kime was shot and killed.
The suspects were apprehended. One was never tried. The other two were convicted of second degree murder. One was sentenced to 25 years and the other to 20. The one sentenced to 20 years was pardoned by Governor Edward Koch on October 22, 1908.
