Deputy Conte was shot and killed during an escape attempting while transporting prisoners to the district office. One suspect arranged an escape attempt with his girlfriend, and when the prisoners were being transported they carried out that plan. The suspect ambushed Deputy Conte and shot him to death. The suspect was convicted of second degree murder and aiding an escape. He was sentenced to 75 years in prison.

Deputy Conte was survived by his brother.
