Policeman Warren Devinish was shot and killed and another policeman was seriously wounded by a man they attempted to arrest at a restaurant on Cherokee Street for disturbing the peace. Other officers arriving on the scene overpowered and arrested the suspect.

Three months later the suspect was convicted of first degree murder.

Policeman Devinish was a former prison guard at Leavenworth Penitentiary.
